Website Services Agreement

Website Services Agreement

This agreement confirms the website services being provided, the agreed project scope, payment terms, confidentiality expectations, and responsibilities of both parties. Please review the agreement carefully before signing.

Client Information

Project Details

This section confirms the website service, agreed pricing, and the work included in your project.

Payment Terms

A deposit is required before project work begins. Any remaining balance is due before the completed website is launched, transferred, or delivered unless another payment arrangement has been agreed to in writing.

Monthly website maintenance services are billed monthly according to the selected maintenance plan.

Additional work outside the agreed scope will be discussed and approved before additional charges are incurred.

Client Responsibilities

The client is responsible for providing accurate content, images, branding materials, website access, and other information reasonably required to complete the agreed work. Project timelines may be affected if required materials, access, approvals, or feedback are delayed.

The client confirms that they have permission to use any text, images, logos, trademarks, or other materials they provide for the website.

Revisions and Additional Work

The agreed project price includes the work described in the Agreed Scope of Work. Requests for additional pages, significant design changes, additional revisions, new functionality, or other work outside the agreed scope may result in additional charges.

Any additional charges will be discussed with the client before the additional work is completed.

Confidentiality

Business information, website materials, account information, login credentials, documents, and other confidential information provided for the purpose of completing website services will be treated as confidential.

Confidential information will not be disclosed to outside parties except with the client's authorization, where reasonably necessary to provide an authorized service, or where disclosure is required by law.

Clients should not provide patient records, personal health information, or other confidential patient information as part of website projects or support requests.

Outside Technical Assistance

If a project requires technical expertise outside the services I can reasonably provide, I may recommend or arrange assistance from a trusted website professional. This may include transferring specific technical tasks or, where appropriate, recommending that the remaining project work be completed by that professional.

The client will be informed before another professional is given access to confidential project information, website credentials, account information, or other confidential materials.

Confidential information or account access will not be shared without the client's authorization. Any additional costs or changes to the project scope resulting from outside technical assistance will be discussed with the client before that work proceeds.

Third Party Services

Websites may rely on services provided by other companies including hosting providers, domain registrars, WordPress software, plugins, themes, Wix, Squarespace, email providers, and other online services.

These services operate independently and their availability, performance, security, pricing, and policies may change. I cannot guarantee the operation or continued availability of services that I do not control.

Website Results

Website services will be provided with reasonable care. Specific search rankings, website traffic, enquiries, sales, revenue, or other business results cannot be guaranteed.

Websites may also display differently across devices, browsers, operating systems, and future software versions.

Website Ownership

Once all agreed project fees have been paid, the client will own the original website content and design work created specifically for the project.

Themes, plugins, fonts, stock images, software, templates, and other licensed or third party materials remain subject to their respective licences and ownership terms.

Cancellation

Either party may request that a project be cancelled.

The client remains responsible for payment for work already completed and expenses already incurred before cancellation. Any refund or remaining balance will be determined according to the amount of work completed and the agreed payment terms.
